1. Introduction

This Privacy Policy describes how USA Homepage LLC, a Delaware limited liability company (“Sponsor,” “we,” “us,” or “our”), collects, uses, shares, and protects personal information when you visit usahomepage.com (the “Site”) or use any of the services offered through the Site (the “Services”). It also describes your choices and rights with respect to your personal information. This Privacy Policy is incorporated into our Terms of Service.

The Site is intended for users located in the United States and the District of Columbia. We do not offer the Services to users outside the United States, and we do not knowingly direct or market the Site to international users.

2. Information We Collect

(a) Information You Provide

We collect personal information you provide directly to us, including:

  • Purchase information: name, email address, billing address, and State of Allocation designation entered at checkout. Payment card details are collected and processed directly by Stripe and are not stored by Sponsor.
  • User Content: images, URLs, captions, and any other content you upload through your Management Link.
  • Direct donation information: name, email address, billing address, donation amount, and selected State of Allocation when you contribute through the “Support DonorsChoose” flow or the optional checkout donation upsell.
  • AMOE Sweepstakes entries: name, mailing address, daytime telephone number, email address, date of birth, and State of Allocation submitted on a free Alternate Method of Entry card under the Sweepstakes Official Rules.
  • Gift information: recipient name, recipient email, scheduled delivery date, and any personal message you include when purchasing as a gift.
  • Support communications: the content of any communication you send to us, including your name, email, and any attachments.
  • Attribution preferences: your selected display preferences for the Honoree Wall and Heroes Ticker, including any opt-in for anonymous display.

(b) Information Collected Automatically

When you use the Site, we automatically collect certain information about your device and your interactions with the Site, including:

  • Log data: IP address, browser type and version, operating system, referring URL, exit URL, date and time of access, and pages viewed.
  • Device data: device type, screen resolution, language settings, and general device identifiers.
  • Usage data: clicks, scroll depth, zoom and pan interactions with the Map, hover events on Pixel-Blocks, and session duration.
  • Attribution data: UTM parameters and other referral signals captured at the start of and during your visit; we capture both first-touch and last-touch attribution to understand how visitors find the Site.
  • Cookies and similar technologies: see Section 5 below.

(c) Information From Third Parties

We may receive limited information about you from third-party service providers, including:

  • Stripe: transaction metadata such as country of issuance, last four digits of the payment card, payment method type, and transaction status. We do not receive full card numbers, CVV codes, or full bank account numbers.
  • DonorsChoose: project receipt data, including names of funded teachers, schools, project descriptions, dollar amounts allocated, and photographs of funded classrooms, which we may publish on the Site's /impact page.
  • Email delivery providers: delivery, open, click, bounce, and unsubscribe data for transactional and (where applicable) marketing emails.
  • Analytics and attribution providers: aggregated and de-identified information about Site traffic and conversion performance.

3. How We Use Information

We use the information we collect to:

  • Process Pixel-Block purchases and deliver Management Links;
  • Operate the Map, display User Content, and render share cards;
  • Allocate the 10% charitable contribution from Pixel-Block revenue, and pass through 100% of direct donations, to DonorsChoose in accordance with each user's State of Allocation;
  • Administer the Sweepstakes, including AMOE entries, drawings, winner notification, and recognition placement on the Honoree Wall and Heroes Ticker;
  • Provide customer support and respond to your inquiries;
  • Send transactional emails (order confirmations, Management Link delivery, image moderation status, recovery emails);
  • Send marketing emails about the Site or related programs, with your consent where required; you can unsubscribe at any time;
  • Detect, investigate, and prevent fraud, abuse, security incidents, and violations of our Terms of Service, Content Policy, or Sweepstakes Official Rules;
  • Comply with legal obligations, respond to lawful requests from public authorities, and enforce our agreements;
  • Analyze and improve the Site, evaluate marketing performance, and develop new features;
  • Create aggregated or de-identified data that does not identify any individual; we may use and share such data for any lawful purpose.

4. How We Share Information

We share personal information only as described below. We do not sell your personal information for money. We do not share your personal information for cross-context behavioral advertising as those terms are defined under California law.

(a) Service Providers

We share personal information with third-party service providers that perform services on our behalf, under written agreements that restrict their use of personal information. These include:

  • Stripe (payments and Stripe Tax). Stripe processes payments and calculates and remits applicable sales tax. Stripe's use of your information is governed by Stripe's privacy policy.
  • DonorsChoose (charitable allocation). For direct donations through the “Support DonorsChoose” flow and the checkout donation upsell, as well as indirect donations for the 10% pixel-block commitment, we share donor name, email, and State of Allocation with DonorsChoose. DonorsChoose is the donor of record for direct donations through the “Support DonorsChoose” flow and the checkout donation upsell and issues donation receipts.
  • Hosting and image CDN. We use cloud hosting and image-CDN providers to operate the Site and serve images.
  • Email delivery. We use email delivery providers to send transactional and (where applicable) marketing emails.
  • Content moderation. We share uploaded images with content moderation service providers (including overseas contractors) that screen content against our Content Policy.
  • Analytics. We use web analytics providers to understand how visitors interact with the Site.
  • Customer support tools. We use help-desk and ticketing tools to manage customer inquiries.

(b) Public Display

Certain information is intentionally public by design:

  • Map placements: uploaded images and the associated URL, if any, are publicly visible on the Map.
  • Honoree Wall and Heroes Ticker: attribution information (first name + last initial for individuals, or organization name for entities, plus State of Allocation) is publicly displayed in accordance with your selected display preference. You may opt to be displayed as Anonymous.
  • Live impact feed: aggregate state-level revenue, donations, and funded classroom counts are publicly displayed; individual buyer identities are not displayed except where the buyer affirmatively opts in.
  • Sweepstakes winners: first name, last initial, and state of winners are publicly announced as part of the Sweepstakes (see Sweepstakes Official Rules).

(c) Legal Compliance and Protection

We may share information when we believe in good faith that disclosure is reasonably necessary to: comply with applicable law, regulation, legal process, or governmental request; enforce our Terms of Service, Content Policy, or Sweepstakes Official Rules; detect, investigate, prevent, or address fraud, security, or technical issues; or protect the rights, property, or safety of Sponsor, our users, or others.

(d) Business Transfers

If Sponsor is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or a portion of its assets, your information may be transferred as part of that transaction. We will use commercially reasonable efforts to provide notice on the Site of any change in ownership or use of your personal information.

(e) With Your Consent

We may share information for any other purpose with your consent or at your direction.

5. Cookies and Tracking Technologies

We use cookies and similar technologies (web beacons, pixels, local storage) for the following purposes:

  • Strictly necessary. Required for the Site to function (e.g., maintaining your checkout session, securing the connection).
  • Analytics. Help us understand how visitors use the Site, including pages viewed, time spent, and conversion paths.
  • Attribution and marketing. Capture UTM parameters and referral data to understand which marketing channels drive traffic and conversions.
  • Preferences. Remember your settings and display preferences.

You may control cookies through your browser settings. Blocking strictly necessary cookies may prevent parts of the Site from working. Where required by law, we present a cookie banner that allows you to manage your cookie preferences.

6. Data Retention

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, including to comply with legal, accounting, tax, audit, or reporting obligations. Specific retention periods include:

  • Pixel-Block purchase records: retained for at least seven (7) years to comply with tax and audit obligations.
  • AMOE entry cards: retained for the duration of the Sweepstakes Promotion Period plus an audit period of at least twelve (12) months, then destroyed (see Sweepstakes Official Rules, Section 12).
  • Uploaded images: retained for the lifetime of the associated Pixel-Block placement on the Map and through any applicable post-closure window.
  • Donation records: retained per the requirements of DonorsChoose and applicable tax law.
  • Email and contact records: retained until you request deletion or until no longer needed for the purpose collected.
  • Analytics data: aggregated or de-identified after twenty-six (26) months in most cases.

7. Security

We use commercially reasonable administrative, technical, and physical safeguards to protect personal information, including HTTPS/TLS encryption in transit, access controls, and reliance on PCI DSS-compliant payment processing by Stripe. No system of safeguards is perfect, however, and we cannot guarantee the security of information transmitted to or from the Site. You are responsible for safeguarding your Management Link and the email account associated with your Pixel-Block.

8. Children’s Privacy

The Site is not directed to children under thirteen (13), and we do not knowingly collect personal information from children under thirteen. Pixel-Block purchases and User Content uploads require users to be at least eighteen (18) years of age under our Terms of Service. If you believe a child under thirteen has provided us with personal information, please contact us at privacy@usahomepage.com and we will take appropriate steps to delete the information.

9. Your Rights and Choices

(a) Email and Marketing Choices

You may unsubscribe from marketing emails at any time using the unsubscribe link in any marketing message, or by contacting privacy@usahomepage.com. You cannot unsubscribe from purely transactional emails (order confirmation, Management Link delivery, refund notifications) while you have an active Pixel-Block placement on the Map.

(b) General Rights

You may request that we: (i) provide you with a copy of the personal information we hold about you; (ii) correct inaccurate personal information; or (iii) delete personal information, subject to retention obligations under applicable law (including tax and Sweepstakes recordkeeping). To make a request, email us at privacy@usahomepage.com. We will verify your identity before responding.

(c) California Residents — CCPA/CPRA Rights

If you are a California resident, the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (“CCPA/CPRA”), provides you with the following rights:

  • Right to know. Request information about the categories and specific pieces of personal information we collect, the sources of that information, the business or commercial purposes for collecting it, and the categories of third parties with whom we share it.
  • Right to delete. Request deletion of personal information we have collected about you, subject to certain exceptions.
  • Right to correct. Request correction of inaccurate personal information.
  • Right to opt out of sale or sharing. We do not sell personal information for money and do not share personal information for cross-context behavioral advertising. There is nothing to opt out of, but you may confirm this status by contacting us.
  • Right to limit use of sensitive personal information. We do not use or disclose sensitive personal information for purposes that would trigger this right under the CCPA/CPRA.
  • Right to non-discrimination. We will not deny you Services, charge different prices, or provide a different level of quality solely because you exercised any of these rights.

To exercise any CCPA/CPRA right, email us at privacy@usahomepage.com. We will respond within forty-five (45) days, subject to extension where permitted. You may use an authorized agent to submit a request; we will require verification of the agent's authority. We may decline a request or charge a reasonable fee where the request is manifestly unfounded or excessive, as permitted by law.

(d) Residents of Virginia, Colorado, Connecticut, Utah, and Other States

If you are a resident of Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Utah (UCPA), or another state with a comprehensive consumer-privacy law, you may have rights substantially similar to the CCPA/CPRA rights above, including the right to access, correct, and delete personal information, and to opt out of certain processing. To exercise any such right, email us at privacy@usahomepage.com. We will verify your identity and respond within the period required by your state's law.

10. Do Not Track

Some web browsers transmit “do not track” signals. Because there is no industry standard for how to respond to such signals, the Site does not currently respond to them. We will update this Privacy Policy if and when an industry standard is adopted.

11. Third-Party Sites

The Site may contain links to or be linked from third-party websites, including the websites of users who attach a URL to their Pixel-Block. We are not responsible for the privacy practices of any third party. Review the privacy policies of any third-party site you visit.

12. International Users

The Site is operated in the United States and is intended for users located in the United States and the District of Columbia. If you access the Site from outside the United States, you do so at your own risk, and your personal information may be transferred to, stored, and processed in the United States. We do not represent that the Site is appropriate or available for use in any non-U.S. jurisdiction.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The Effective Date at the top of this Privacy Policy indicates when this version was last updated. Material changes will be communicated to you by email (using the address on file for your most recent Pixel-Block purchase) or by prominent notice on the Site at least thirty (30) days before the changes take effect, except where shorter notice is required for legal or security reasons. Your continued use of the Site after the effective date of a change constitutes acceptance of the modified Privacy Policy.
